Felvium Terms of Service (User Agreement)

These Terms of Service (the “Terms”) are a legal agreement between you and Felvium Team (“Felvium”, “we”, “us”, or “our”) governing your access to and use of the Felvium mobile application and related services (collectively, the “Service”).

1) The Service

Felvium – Fitness Video Community is a native iOS app built for people who want to discover, watch, and share workout videos. You can browse training ideas by category, scroll an immersive full-screen video stream, and publish your own clips to inspire others.

2) Eligibility

You must be at least 17 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

3) Accounts and Security

3.1 Account information

You may need to create an account to access certain features. When you create an account, you may provide information such as your name (optional), username, and email address.

3.2 Account security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access to your account.

3.3 Accuracy

You agree to provide accurate, current, and complete information and to keep it updated.

4) User Content

4.1 Your content

The Service may allow you to upload, post, or transmit content, including videos, captions, comments, profile information, and other materials (“User Content”).

4.2 Rights you grant to Felvium

You retain ownership of your User Content, subject to the license you grant below. By submitting User Content to the Service, you grant Felvium a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for technical formatting only), adapt, publish, display, perform, distribute, and make your User Content available as necessary to operate, provide, and improve the Service, and as otherwise permitted by your settings and actions within the Service.

4.3 Your responsibility for User Content

You represent and warrant that:

• You own or have the necessary rights to submit your User Content and to grant the license above.
• Your User Content does not violate any law or the rights of any third party (including intellectual property, privacy, or publicity rights).

4.4 Content moderation and removal

We may (but are not required to) review, monitor, or remove User Content at our discretion, including if we believe it violates these Terms, is unlawful, or may harm the Service or others. We may also suspend or terminate accounts as described below.

5) Acceptable Use

You agree not to:

• Use the Service for illegal, harmful, or abusive activities.
• Harass, threaten, or defame others, or encourage violence or discrimination.
• Upload content that is obscene, pornographic, or otherwise inappropriate for a 17+ audience.
• Infringe or violate any intellectual property or other rights of others.
• Attempt to gain unauthorized access to the Service or other users’ accounts.
• Interfere with or disrupt the Service, including by introducing malware, scraping, or automated abuse.
• Reverse engineer, decompile, or attempt to derive source code from the Service, except to the extent permitted by law.
• Use the Service to collect personal data about others without permission.

6) Fitness and Medical Disclaimer

The Service is for informational and entertainment purposes only. Felvium is not a medical provider and does not provide medical advice. Always seek the advice of a qualified healthcare professional before starting any exercise program. You are responsible for your own health and safety when viewing or performing any workouts.

7) Privacy

Our privacy practices are described in our Privacy Policy. Please review it to understand how we collect and use information. If you do not agree with our privacy practices, do not use the Service.

8) Intellectual Property

8.1 Our rights

The Service, including its software, design, text, graphics, logos, and other content (excluding User Content), is owned by or licensed to Felvium and is protected by applicable intellectual property laws.

8.2 Limited license to you

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms.

9) Third-Party Services and Platforms

The Service may rely on or interact with third-party services (for example, Apple’s iOS features). Your use of those third-party services is governed by their terms and policies, and Felvium is not responsible for them.

10) Termination

10.1 Termination by you

You may stop using the Service at any time. You may also request account deletion through available in-app settings or by contacting us.

10.2 Termination by Felvium

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, created risk or potential legal exposure for us, or if we must do so to comply with law or to protect the Service or other users.

10.3 Effect of termination

Upon termination, your right to use the Service will stop. Sections that by their nature should survive will survive, including but not limited to: User Content licenses (to the extent needed to operate the Service and comply with law), disclaimers, limitations of liability, indemnity, and dispute resolution.

11) Disclaimers

The service is provided “as is” and “as available”. To the maximum extent permitted by law, Felvium disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free.

12) Limitation of Liability

To the maximum extent permitted by law, in no event will Felvium Team be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of (or inability to use) the service, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, Felvium Team’s total liability for any claim arising out of or related to the service or these terms will not exceed the amount you paid to Felvium for the service in the 12 months before the event giving rise to the claim, or USD $100 if you paid nothing.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13) Indemnification

You agree to indemnify, defend, and hold harmless Felvium Team from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your User Content; or (c) your violation of these Terms or any applicable law.

14) Governing Law

These Terms are governed by the laws of the jurisdiction of Felvium Team’s principal place of business, without regard to conflict of laws rules, except where such choice of law is not permitted.

15) Dispute Resolution and Binding Arbitration

You and Felvium Team agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms (a “Dispute”) will be resolved by binding arbitration, except that either party may: (a) bring an individual claim in small claims court if it qualifies; or (b) seek injunctive or equitable relief in a court of competent jurisdiction for unauthorized use or infringement of intellectual property rights.

Arbitration will be conducted on an individual basis. You and Felvium Team agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that individual party’s claim. The arbitration will be conducted in a reasonable location and manner determined under the applicable arbitration rules, and judgment on the award may be entered in any court having jurisdiction.

16) Changes to the Service or Terms

We may modify the Service and may update these Terms from time to time. If we make changes, we will post the updated Terms with a new effective date. Your continued use of the Service after changes become effective means you accept the updated Terms.
